My husband was driving in slushy snow when he came up over a hill with little sight distance (maybe 10 ft) when he saw a car backing up because he couldn't make it up the hill. The country road is not a full 2 lanes, maybe equivalent to 1 1/2. The other car was in the middle of the road and stopped and put on his flashers when he saw my car coming. My husband attempted to avoid the car, but couldn't. The other guys insurance co. is putting us 100% at fault. It seems to me the person at fault is the person whose negligence caused the accident (like being stuck in the middle of the road.) Should I keep fighting with them or just go to my state's (NY) insurance Department? Your husband is at fault. It is generally accepted that the driver is responsible for controlling his car in response to whatever is in front of him. If the sight distance is only 10 feet then that would dictate extremely slow cautious driving is in order. Stop fighting. Sorry, the insurance carrier is right. You have to expect and anticipate the vehicle (or child.. or animal) in front of you could do anything at any moment. You must maintain proper lookout so if they stop suddenly you can avoid them. You can't just hit a car because its stopped in the middle of the roadway... It sounds to me like your husband was driving too fast for the winter conditions and failed to control his vehicle to avoid the collision. It doesn't sound good for you, but that doesn't mean there isn't hope. Find a lawyer, and ask them with greater detail. They will be able to tell you exactly how much liability is yours and if you should continue fighting. If it is worthwhile they will fight it for you, which is often the best path with insurance. If a lawyer won't take the case, its best to just quit. You can state on the one hand that your husband may have been drivinig "too fast for conditions." On the other hand, generally whoever is backing up is at fault for not looking and clearing view behind before proceeding. Did anyone get issued a ticket? Was the other vehicle stopped or were they backing up? If they were just stopped, then your hsuband was at fault. If the other driver was back-up, then I would put at least some fault on them. Dodge . How to Change a CV Joint in a NissanThe CV joint on a Nissan is part of the drive shaft, which transmits the engine's power to the front wheels. The CV joint functions as a fully articulated connection, much like a person's wrist. It allows constant power even when the wheels are moved as in the act of steering the vehicle. If the problem with the CV joint is simply a ripped rubber boot covering the CV joint, there is not a monetary advantage to having the boot replaced. The work required to separate the joint and install a boot would cost more than a rebuilt shaft from the auto parts store. Difficulty:Moderately Challenging Instructions Things You'll Need Floor jack Jack stands 3/8-inch drive ratchet Set of 3/8-inch drive sockets Lug wrench Long pry bar ½-inch drive breaker bar 38mm socket Tie rod separator Hammer Set of wrenches Step by Step : 1 Raise the front of the vehicle with the floor jack and place the jack stands under the frame for support. Remove the wheel, using the lug wrench. Remove the large 38mm nut securing the drive shaft to the spindle, using the breaker bar. 2 Remove the nut on the lower ball joint stud, using a wrench. Insert the tie rod separator tool between the spindle and the lower control arm, then strike the tool with the hammer until the two separate. Lift up the spindle to separate the lower ball joint stud from the spindle. Move the spindle toward the rear of the vehicle. 3 Push in the CV joint shaft to separate it from the spindle. If it does not want to come out of the spindle easily, install the large nut upside down on the shaft and tap gently to start it sliding out of the spindle. Lay the CV joint shaft on the lower control arm once separated. 4 Insert the large pry bar between the inner CV joint and the transmission. Pry the joint out of the transmission. 5 Insert the new CV joint into the transmission. The joint has a circlip on the end, so the shaft will only go in as far as the circlip before stopping. Grab the outer CV joint threaded shaft with both hands and give a quick push on the shaft--it will snap into the transmission. 6 Insert the outer CV joint threaded shaft into the spindle. Rotate the rotor slightly while inserting the shaft to align the splines. Once the shaft starts to slide into the spindle, if it does not pass through enough to install the large 38mm nut, grab the rotor on the spindle with both hands and slam it inward. 7 Screw the large nut on the CV shaft loosely. Lift the spindle and place it on top of the lower ball joint. Allow the lower ball joint stud to slide into the hole in the spindle. Install the nut on the lower ball joint stud and tighten with a wrench. 8 Tighten the large 38mm nut with the breaker bar until the CV joint is drawn completely into the spindle. Install the wheel and lower the vehicle.

If you wipe off any thick, black, grease from around the CV joint area, this is axle grease. It means that the boot has failed, and the CV joint will dry out and fail soon. The CV joint must be replaced. 4 Drive the vehicle and pay special attention to any sounds coming from the front wheel wells. If you hear a clicking sound as you make hard left or right turns, this indicates that your CV joint is failing and must be replaced right away.
